Under Montana law: “A person commits the offense of theft of identity if the person purposely or knowingly obtains personal identifying information of another person and uses that information for any unlawful purpose…”   The law is codified in Montana Stat. § 45-6-332.

Kentucky law says that a person commits identity theft by using the identifying information of another person in order to to commit some kind of fraud, such as – among other things – obtaining goods and services.  The statute itself is Kentucky Statute § 514.160.  As with many other states, Kentucky law not only addresses the use of someone else’s personal information to commit a crime or fraud, but also trafficking (e.g., buying and selling) such information (Kentucky Statute § 514.170).
